Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PhotoGuide AI mobile application and this website (together, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

To use most features you must create an account using email or Google Sign-In. You are responsible for:

• Providing accurate account information and keeping it up to date.
• Maintaining the confidentiality of your credentials.
• All activity that occurs under your account.

Notify us promptly of any unauthorised use of your account.

You agree to use the Service lawfully and responsibly. You must not:

• Interfere with, disrupt or attempt to gain unauthorised access to the Service.
• Reverse engineer, scrape or misuse the Service or its AI systems.
• Use the Service to violate the rights of others or any applicable law.
• Attempt to overwhelm, probe or circumvent security or usage limits.

You must not upload or submit content that is:

• Illegal or that violates any applicable law.
• Copyright-infringing or otherwise violates third-party rights.
• Offensive, abusive, hateful or harassing.
• Malicious, including malware or harmful files.
• Otherwise in breach of these Terms or applicable regulations.

We may remove content and suspend accounts that violate these rules.

You are solely responsible for the photographs you upload and must have the rights necessary to submit them for analysis. Photographs are used only to generate your AI analysis and are handled as described in our Privacy Policy.

Your ownership. You retain full ownership of all photographs you upload. No ownership of your images is transferred to PhotoGuide AI.

Our property. The PhotoGuide AI name, logo, software, design and content are owned by PhotoGuide AI and protected by intellectual property laws. You may not use them without our prior written permission.

To provide the Service, you grant PhotoGuide AI a limited, non-exclusive, revocable license to process, store and display the photographs you upload solely for the purpose of generating and delivering your AI analysis and related features. This license does not transfer ownership and ends when your test account is reset, or when your account is deleted by an administrator upon a verified request, subject to routine backups.

Analysis, scores and recommendations are generated by an automated AI system and are provided for educational purposes only. They are intended to help you improve and are not a professional certification, an objective measure of quality, or a guarantee of any result. You are responsible for your own creative decisions.

AI-generated feedback should not be considered professional photographic, legal, financial, medical, or other expert advice.

Certain features, such as AI analyses, may consume credits. Your available balance is shown in the app. Credits have no monetary value, are non-transferable, and are non-refundable except where required by applicable law. We may adjust how credits work with reasonable notice. Any expiration or changes to credits will always be clearly communicated inside the application.

We may introduce paid plans or subscriptions in the future. If we do, applicable pricing, billing and cancellation terms will be presented to you before purchase, and any purchases made through Google Play will also be subject to Google’s terms. Any future subscription will always require your explicit purchase confirmation before any payment is made.

We may suspend or terminate your access if you violate these Terms, misuse the Service, or where required by law. You may stop using the Service at any time.

You can use the in-app “Reset My Test Account” feature to remove your application-generated data. Permanent account deletion is not performed from within the app — it is carried out by a PhotoGuide AI administrator upon a verified request sent to support@photoguide-ai.com, which permanently removes your account, profile, analyses, portfolio and generated AI data.

Upon termination, your right to use the Service ends and associated data is handled in accordance with our Privacy Policy.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or that AI feedback will meet your expectations.

To the maximum extent permitted by applicable law, PhotoGuide AI and its providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the Service.

We may modify, suspend or discontinue any part of the Service, and we may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Your continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which the operator of PhotoGuide AI is established, without regard to its conflict-of-law principles. Any disputes will be subject to the courts of that jurisdiction, unless otherwise required by mandatory local law.
